O R D E R
This writ petition has been filed for direction to the respondents to pay the amount of Rs.26,558/- to the 1st Petitioner, Rs. 36,962/- to the 2nd Petitioner, Rs.32,020/- to the 3rd Petitioner by considering their representations towards Encashment of Earned Leave surrendered by the Petitioners 1 and 2 and by the husband of the 3rd Petitioner along with 12 percentage interest per annum from the date of retirement.
2. The case of the petitioners is that Petitioners 1 and 2 and the husband of the 3rd Petitioner are the retired employees of the Respondents/Corporation. The grievance of the petitioners is that the respondents have to pay the amount of Rs.26,558/- to the 1st Petitioner, Rs. 36,962/- to the 2nd Petitioner, Rs.32,020/- to the 3rd Petitioner towards Encashment of Earned Leave surrendered by the Petitioners 1 and 2 and by the husband of the 3rd Petitioner. Hence, the petitioners made representations to the respondents. However, no action has been taken by the respondents till date. Hence this petition. 2/6
3.The learned counsel for the petitioners submitted that it would be suffice if this Court issues a direction to the respondents to consider the petitioners' representations and pass orders.
4. The learned Standing Counsel appearing for the respondents submitted that the representations of the petitioners will be considered and will pay the eligible amount with 6% interest per annum as per the earlier orders of this Court.
5. Considering the facts of the case, this Court directs the respondents to consider the representations of the petitioners and pass orders on the claim made by the petitioners within a period of twelve weeks from the date of receipt of a copy of this Order. With regard to interest for the belated payment it will be 6% interest per annum interest from the date on which the amount became due and payable till the date of disbursement. It is made clear that if the amount is not paid within the time frame fixed by this Court, the same will carry interest at the rate of 12% per annum from the date on which the amount became due and 3/6
payable till the date of disbursement.
6.With the above directions, this Writ Petition stands disposed of. No order as to costs.
