ORDER
The appellant has filed this Criminal Appeal to set aside the order dated 15.10.2025 passed in Crl.M.P.No.1389 of 2025 by the Learned District and Sessions Judge, Tirupattur and to enlarge him on bail.
2. Heard the learned counsel appearing for the appellant and the learned counsels appearing for the respondents and perused the materials placed before this Court.
3. The learned counsel for the appellant submitted that the appellant has been falsely implicated in this case. He further submitted that he is ready to
abide by any conditions, imposed by this Court.
4. The learned Government Advocate (Crl. Side) raised objections stating that the petitioner is involved in a total of eight previous cases and that the present cases are at the stage of framing charges. However, on one occasion, he failed to appear before the Court, and therefore, a non-bailable warrant was issued against him.
5. Considering the above facts and circumstances, it is a case of jumped bail, and he is ready to abide by any conditions, this Court is inclined to grant bail to the appellant. Accordingly, the order made in Crl.M.P.No.1389 of 2025 dated 15.10.2025 on the file of the District and Sessions Judge, Tirupattur is hereby set aside. This Criminal Appeal stands allowed.
6. The appellant is ordered to be released on bail on his execution of a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned District Sessions Judge,
Tirupattur and on further conditions that:
[a] The appellant is directed to deposit a sum of Rs.20,000/- to the credit of Spl.S.C.No.168 of 2024, on the file of the District and Sessions Judge, Tirupattur, within a period of two weeks from the date of receipt of a copy of this order.
(b) The appellant and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [c] the appellant shall report before the respondent police as and when required for interrogation.
[d] the appellant shall not abscond either during investigation or trial. [e] the appellant shall not tamper with evidence or witness either during investigation or trial.
[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the appellant in accordance with law as if the conditions have been imposed and the appellant released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[g] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS.
(h) The defacto complainant is permitted to withdraw the said
