ORDER

This Criminal Revision case has been filed to set aside the order of dismissal dated 13.08.2025 in Crl.M.P.No.1393/2025 in CC No.5003/2025, on the file of the Judicial Magistrate-I, Salem.

2. The brief facts of the case:

The respondent police has freezed the petitioner's bank account with Kotak Mahindra Bank(Account No. 6348115147) and Bank of Baroda(Account No. 74790100001115) in connection with Crime No. 104 of 2025. Thereafter, the petitioner filed Crl. MP. No. 1393 of 2025 in C.C No. 5003 of 2025 before the Judicial Magistrate-I, Salem, seeking to defreeze his above said bank account. On hearing both sides, the Trial Court has dismissed the said petition by holding that the petitioner is one of the accused in the said case which requires detailed investigation. Aggrieved over the same, the petitioner filed this Criminal Revision Case.

The learned counsel for the petitioner submits that due to freezing of the petitioner's bank account the petitioner is facing severe financial hardship and undue suffering to the petitioner and his family. Further, his wife has pledged 25 sovereigns of gold in the said bank account and Rs.30,000/- lying in the said bank account. Hence, he prays to defreeze the petitioner's account.

4. The learned Government Advocate raised objection allow this

Criminal Revision Case.

5. Considering the facts of the case, the petitioner is arraigned as A6 and contraband seized in this case is intermediate quantity and a sum of Rs.30,000/- lying the petitioner's bank account. According to the petitioner, he is not able to run his day to day affairs of the family. Hence, the respondent police is directed to defreeze the petitioner's bank account in connection with crime No. 104 of 2025. Accordingly, the order of dismissal dated 13.08.2025 passed by the Judicial Magistrate-I, Salem in Crl.M.P.No.1393/2025 in CC No.5003/2025 is hereby set aside. Further, the petitioner shall cooperate the Trial proceedings.
