This Criminal Miscellaneous Petition has been filed to condone the delay of 1672 days in filing the Appeal.

2. Mr.A.Damodaran, learned Additional Public Prosecutor takes notice for the respondent and has objected to condoning the inordinate delay.

3. Considering the fact that the petitioner/appellant has been in prison from the date of conviction and could not mobilize funds to prefer the appeal, we are inclined to condone the delay of 1672 days.

4. Accordingly, this petition is ordered and the delay is condoned.

5. Registry is directed to number the appeal, if the same is otherwise in order.
