ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 08.09.2025 for the offences punishable under Section 303(2) of BNS in Crime No.569 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 08.09.2025, when the defacto complainant was waiting outside the bank, after withdrawing her pension amount of Rs.17,500/-, the petitioner herein under the guise of enquiring about her illness, asked her to come with him in his bike and taken her bag in which the amount was kept; that while the defacto complainant refused to come with him, the petitioner returned her bag after taking away the amount of Rs.17,500/- and fled away from the place. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 08.09.2025; and that the petitioner is ready to abide by any 2/4

condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the stolen money was recovered from the petitioner herein; that the petitioner has 39 previous cases; and that the major part of the investigation has been completed. 5.

In reply, the learned counsel for the petitioner submitted that though there are previous cases as against the petitioner herein, majority of the cases ended in acquittal, hence prays to grant bail. 6.

I have considered the submissions made on both sides and perused the materials available on record. Though, it is stated that the stolen money was recovered, considering the nature of offence, the previous antecedents of the petitioner and if the petitioner is enlarged on bail, he would indulge in similar offence, hence this Court is not inclined to grant bail to the petitioner.
