ORDER

(Order of the Court was made by the Hon'ble G.Jayachandran J.) The defendant, who is suffering a money decree before the Trial Court, has preferred this appeal with a delay. He has also sought for stay of the judgment and decree passed by the Execution Court till the disposal of this appeal.

2. The learned counsel appearing for the respondent/decree holder submitted that the decree was passed for recovery of the salary benefits due to the plaintiffs. The petitioner, despite receipt of notice, has not paid the decree amount. Consequently, Execution Petition No.1539 of 2025 was filed before the IX Assistant City Civil Court, Chennai. Only thereafter, the petitioner has chosen to file the present appeal with a substantial delay of 260 days. It is further submitted that even during the course of the trial, the petitioner had expressed financial difficulty in meeting his commitments, and therefore, if

the attachment of the bank account is raised, the respondent/decree holder would be left with no means to recover the decretal amount.

3. The learned counsel appearing for the appellant/petitioner submitted that the attachment of the bank account has completely crippled the financial activities of the appellant. He therefore prayed for raising the attachment and expressed his willingness to furnish alternate security for the decretal amount.

4. Considering the rival submissions, this Court is of the view that if the judgment debtor deposits a sum of Rs.30,00,000/- in the Execution Petition account, the order of attachment of his bank account dated 03.11.2025 may be raised.

5. Accordingly, we dispose of this stay petition with the following conditions:

(i) The judgment debtor, who is the petitioner/appellant herein, shall deposit a sum of Rs.30,00,000/- in the Execution Petition account in E.P.No.1539 of 2025 within a period of three (3) weeks; and

(ii) On such deposit, the order of attachment of the bank account passed in the said Execution Petition on 03.11.2025 shall stand raised.
