O R D E R
The present Writ Petition (Criminal) has been filed seeking a direction to respondents 1 to 4 to provide police protection to the petitioner and her family.
It is the grievance of the petitioner that since she has given a complaint against the fifth respondent due to his audacity with her and her husband, the fifth respondent, after coming out on bail in the said case, along with one Kavitha, threatened her and her family with dire consequences and also damaged her house by pelting stones. Hence, the present petition has been filed seeking police protection. Mr.K.M.D.Muhilan, learned Additional Public Prosecutor takes notice on behalf of respondents 1 to 4. In view of the consent expressed by the learned counsel on either side, this Writ petition (Criminal) is taken up for final disposal at the 2/5
admission stage itself. Notice to the fifth respondent is dispensed with inasmuch as no order prejudicial to his interest is passed. Learned Additional Public Prosecutor, on instructions, submitted that based on the complaint dated 17.06.2025 given by the petitioner, a case in Crime No.439 of 2025 was registered for the offence under Sections 296(b), 115(2) and 351(3) of the BNS against the fifth respondent herein and subsequently, on the complaint dated 08.07.2025, a case in Crime No.473 of 2025 was registered for the offences under Sections 296(b) and 351(3) of the BNS and Section 4 of TN Public Property (Prevention of Damage & Loss) Act, 1992, against the fifth respondent and the said Kavitha. The respondent Police are taking suitable action on the above complaints. He further submitted that a patta book has been maintained at the house of the petitioner and the respondent police are conducting regular patrol and providing protection to the petitioner. 6.
Recording the submissions made by the learned Additional Public Prosecutor, this Writ Petition (Criminal) stands closed. No costs. 27.11.2025 ham 3/5
