ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.09.2025 for the offences punishable under Sections 311 @ 311, 61(2) r/w 3(5) of BNS Act, 2023 in Crime No.401 of 2025, registered on the file respondent police, seeks bail.

2.The allegation against the petitioner is that the petitioner joining hands with the other accused had conspired and they followed the de-facto complainant and also attacked him at knife point and robbed the cash worth about Rs.45,68,000/-. The respondent police arrested the petitioner on 25.09.2025. Hence the case.

3.The learned Counsel appearing for the petitioner submitted that the petitioner and other accused are only friends with one Pandi. The petitioner has handed over his bike for the purpose of personal use of one Pandi and he was not aware about the occurrence and he has been falsely implicated in this case. He further submits that the petitioner is ready to abide any condition imposed by this Court. Hence, he prays bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submits that totally seven accused involved in this case. The petitioner was arrested and remanded to judicial custody and the statement of the petitioner herein was also recorded and it reveals that for the past one month, the petitioner joining hands with other accused had conspired, they fixed the date and stalking the de-facto complainant and attacked him at knife point and robbed Rs.45,68,000/-. He further submits that so far no amount has been recovered from the petitioner. He opposed for grant of bail to the petitioner.

5.Considering the gravity of the offence committed by the petitioner; that so far no amount has been recovered, that the main accused are still absconding; if bail is granted to the petitioner he would indulge in similar activities and hamper the investigation. Hence, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed.
