PRAYER: This Writ Petition is filed under Article 226 of Constitution of India in the nature of Writ of Mandamus, directing the 1st respondent to approve the Podhu Mahajana Sabai, Nirvaga Sabai, Paribalanam Bye-Laws2011 for Adhalaiyur Karaipakkam Muslim Oor Uravin Murai Jamath under Section 69 of the Wakf Act 1995 (as amended 2013), to conduct a election to elect new management committee by way of secret ballot for the above referred Pallivasal by considering the petitioner's representation dated 05.09.2025 within a period as stipulated by this Court. ORDER
Heard Mr.L.Gavaskar, learned counsel appearing for the petitioner and Mr.Mohammed Fayaz Ali, learned Standing Counsel appearing for the respondents.
2.The petitioner's grievance is that the 4th respondent, despite expiry of his period, appointing him as Muthavalli, continues to manage the Wakf beyond the expiry of his term as early as in August 2024. According to the 2/5
petitioner, the said Muthavali has even conducted General Body Meeting and selected a new Committee. The grievance of the petitioner is that, the Muthavali has no authority to convene such General Body Meeting. In this regard, the petitioner has already given a representation to the respondents on 06.08.2025 and 05.09.2025.
3.The learned Standing Counsel appearing for the respondents submits that necessary action has already been initiated. But however, since the Board has not yet been constituted, the respondents require some more time to dispose of the petitioner's representation on merits and in accordance with law.
4.Considering the above and the limited prayer sought for in the writ petition, being only for a direction to dispose of the petitioner's representation, I am inclined to dispose of the writ petition directing the 2nd respondent to dispose of the petitioner's representation dated 05.09.2025 on merits and in accordance with law within a period of eight weeks from the date of constitution of the Board. Accordingly, this writ petition stands disposed of. No costs.
