Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondent to forthwith close or relocate the liquor shop No.11069 (TASMAC), Vijilapuram Village, Vaniyamadi Taluk, Tirupattur District as per the provisions of Tamilnadu Prohibition Act and Rules.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Though number of grounds have been urged in the petition for issuance of writ of mandamus for closure of a TASMAC shop, the contents of the petition and the representation as also the report of the Village Administrative Officer only show that there is a public objection on account of there being a liquor shop in the area.

2. In the absence of violation of any law, no writ of mandamus can be issued.

3. However, the competent authority may examine, on the administrative side, the report of the Village Administrative Officer of Kothakottai, Alangayam Sub-Taluk, Vaniyambadi Taluk, Tirupattur District and take his own decision.

Petition is, accordingly, closed. There shall be no order as to costs.
