ORDER
The petitioners, who were arrested and remanded to judicial custody on 06.10.2025, for the alleged offence punishable under Sections 296(b), 132, 123, of BNS and 8(c), 20(b)(ii)(A), 22(b), 25 & 29(1) of the NDPS Act in Crime No.596 of 2025, on the file of the respondent police, seek bail.
2. The allegation against the petitioners is that the petitioners are involved in possession and trafficking of 20 grams of ganja and 7 grams of cocaine. Apart from that, petitioners were found in possession of banned tobacco products, 21 packets of cool lip. Hence, they were arrested and remanded to judicial custody. Hence, the case.
3. Learned counsel appearing for the petitioners submitted that the petitioners were originally arrested and remanded on the basis of political reasons. He further submitted that the petitioners have not committed any offence, and they have no previous case. Hence, he prayed for grant of bail to the petitioners.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police denied the allegations levelled by the petitioners, and submitted that 20 grams of ganja and 7 grams of cocaine were recovered. He further submitted that the petitioners are not having any previous case. However, he opposed for grant of bail to the petitioners.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the period of incarceration undergone by the petitioners, and seized contraband is not commercial quantity, this Court is inclined to grant bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on bail on their executing a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Principal Special Court under EC & NDPS Act, Chennai, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b] the petitioner shall report before the Trial Court daily
at 10.30 a.m., for a period of two weeks.
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
