ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 112, 318(2), 318(4), of BNS r/w Section 5, 7(3) of the Lotteries Act, in Crime No. 417 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused was in possession of 66 banned lottery tickets to sell the same in a public at large. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case based on the confession of A1 and the petitioner is also ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner is ranked as A2 and he is having four previous cases. He opposed to grant anticipatory bail to the petitioner.

5. Considering the gravity of offence committed by the petitioner; that the petitioner is having four previous cases similar in nature and if anticipatory bail is granted to the petitioner, he would indulge in similar activities in the future, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed. 10.11.2025 MSM To
