Respondents This case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.S.Arunkumar, learned counsel for the Appellant and the respondents are appeared in person are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.57,48,000/- with interest at 7.5% per annum, from the date of petition, till the date of realization with costs. Challenging the quantum of compensation, the United India Insurance Company has preferred the present appeal.
2. After due deliberation and consultation, both the parties have agreed to settle the claim for a sum of Rs.48,00,000/- (Rupees Forty Eight Lakhs only) with interest at 7.5% p.a and costs, less the amount already deposited if any.
3. The appellant / Insurance Company is directed to deposit the balance amount to the credit of M.C.O.P.No.1878 of 2017 on the file of the Motor Accident Claims Tribunal, Cuddalore, within a period of six weeks from the date of receipt of a copy of this order.
4. On such deposit being made, the Tribunal is directed to transfer the Award amount to the Bank account of the claimants by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition. The claimants are entitled to withdraw the Award amount thereafter.
5. The first and second respondents are majors and the third respondent is said to attained majority after declaring the minor as major
the lower Court shall distribute the amount apportioned by the tribunal.
6. With the above terms, the Civil Miscellaneous Appeal is disposed of. No costs.
