Respondents Prayer : Writ Petition filed under Article 226 of the Constitution praying to issue a Writ of Mandamus, directing the respondents to pay the petitioner a sum of Rs, 1,61,833/- towards arrears of difference in pension for the period from Nov. 2018 to May 2025 ; to pay the petitioner a sum of 42,000/- towards the social security scheme and Rs. 15,000/- towards the family benefit fund scheme to pay the petitioner a sum of Rs . 4,500/- towards the IRT contributions together with interest at the rate of 12 % per annum and to pay the petitioner interest at the rate of 12 % per annum for the belated payment of Rs. 1,00,475/- towards PF amount.

O R D E R

This Writ Petition has been filed for direction directing the respondents to pay difference in pension, social security scheme, family benefit fund scheme and IRT contribution together with interest at the rate of 10% to the petitioner.

2. Heard the learned counsel for both sides and perused the materials available on record.

3. The petitioner was working as a Conductor in the first respondent Corporation and he retired from service on 31.10.2018, on attaining the age of superannuation.

4. A settlement was entered into between the Union and the Management on 01.09.2016. But it was made applicable with effect from 01.04.2018. Therefore, the petitioner was also entitled to the benefit under the said settlement, dated 01.09.2016. But his terminal benefits were settled 2/4

without reference to the terms of the settlement. Therefore, the petitioneris entitled not only to the difference in benefits, but also interest thereon.

5. This stand of the petitioner cannot be disputed. Therefore, the respondents are directed to pay difference in leave salary, difference in in pension, social security scheme, family benefit fund scheme and IRT contribution as per the wage settlement dated 01.09.2016. Those amounts shall be paid within period of twelve weeks from the date of receipt of a copy of this order. The respondents have to make the differential payment with 6% interest per annum to be computed from the date of the petitioners' retirement till the date of payment.

6. With the above said observations, this Writ Petition stands disposed of. No costs.
