Respondents Prayer : Writ Petition filed under Article 226 of the Constitution praying to issue a Writ of Mandamus, directing the respondents to pay the petitioner a sum of Rs, 4,500/- towards the IRT contributions ; to pay the petitioner a sum of Rs. 27,552/- towards the difference in pension for the period of Nov 2023 to August 2025 ; to pay the petitioner a sum of Rs. 10,761/- towards the difference in Surrendered Earned leave wage ; to pay the petitioner a sum of Rs.28,800/- towards arrears of difference in Dearness allowances for the period from Jan 2017 to Oct 2023 together with interest at the rate of 12% per annum and to pay the petitioner interest at the rate of 12% per 1/5

annum for the belated payment of Rs. 11,11,935/- towards PF and for the belated payment of Rs. 1,19,595/- towards Earned Leave/ Medical leave salary.

O R D E R

This Writ Petition has been filed for direction directing the respondents to pay difference in IRT Contribution, pension, surrendered earned leave wages, dearness allowance and for the belated payment of provident fund and earned leave, together with interest at the rate of 12% to the petitioner.

2. Heard the learned counsel for both sides and perused the materials available on record.

3. The petitioner was working as a Conductor in the first respondent Corporation and he retired from service on 31.10.2023, on attaining the age of superannuation.

4. A settlement was entered into between the Union and the Management on 01.09.2023. But it was made applicable with effect from 29.05.2025. Therefore, the petitioner was also entitled to the benefit under the said settlement, dated 01.09.2023. But his terminal benefits were settled without reference to the terms of the settlement. Therefore, the petitioner is entitled not only to the difference in benefits, but also interest thereon.

5. This stand of the petitioner cannot be disputed. Therefore, the respondents are directed to pay difference in IRT Contribution, pension, surrendered earned leave wages, dearness allowance and for the belated payment of provident fund and earned leave, as per the wage settlement dated 01.09.2016. Those amounts shall be paid within period of twelve weeks from the date of receipt of a copy of this order. The respondents have to make the differential payment with 6% interest per annum to be computed from the date of the petitioner's retirement till the date of payment. 3/5

6. With the above said observations, this Writ Petition stands disposed of. No costs.
