ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.10.2025, for the alleged offence punishable under Sections 123 of BNS r/w 7, 20(1) of COTPA Act and Section 4(1)(C) of TNP (Amendment) Act, in Crime No.452 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner involved transportation of banned tobacco products of 315 kgs from Karnataka to Tamil Nadu along with 6 litres of Karnataka State liquor for the purpose of selling to this State. The police have intercepted the car used for transportation and petitioner was arrested with the contraband. Hence this case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 24.10.2025 and ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that the contraband seized 2/4

is a huge quantity and the petitioner is in custody only from 24.10.2025 investigation is pending, and opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the huge quantity contraband seized and the petitioner is arrested only recently, investigation is not completed, and this Court is not inclined to grant bail to the petitioner.
