ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.10.2025, for the alleged offence punishable under Sections 308(4), 351(2) of BNS, in Crime No.499 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner belongs to some political party. He assisted the defacto complainant in claiming the compensation amount of Rs.1 crore for the death of the defacto complainant's son in an accident. Accordingly, the petitioner along with some others, demanded and extorted a sum of Rs.10 lakhs. Subsequently, the petitioner along with his men threatened the defacto complainant for paying some more money. Hence, the defacto complainant lodged a complaint against the petitioner and demanding back the money extorted by them.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he is a sick person. He would further submit that the petitioner was arrested and he is in judicial custody from 05.10.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent 2/4

police reiterated the prosecution's case and submitted that totally 3 accused in this case and all were arrested, this petitioner is ranked as A2 and no previous case is pending against the petitioner, the huge amount has been extorted by the petitioner from the defacto complainant, and opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the petitioner is extorted money from the defacto complainant, and if the petitioner is granted bail at this stage he will indulge in similar activities, this Court is not inclined to grant bail to the petitioner.
