ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.09.2025, for the offence punishable under Sections 376(1), 376(2)(n) of IPC Act r/w 5(1) & 6 of POCSO Act, 2012, in Crime No.19 of 2025, registered on the file of the respondent, seeks bail.

2. The allegation against the petitioner is that the petitioner is neighbor of the victim girl aged about 15 years and taking advantage of her loneliness and committed aggravated penetrative sexual assault. Subsequently, it was revealed to the family members and a case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged by the prosecution. He further submitted that there are no specific allegations against the petitioner regarding any sexual assault and that he has been falsely implicated in this case. He also submitted that the petitioner is ready to abide by any conditions imposed by this Court. Hence, he prayed that bail may be granted to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the victim girl is aged about 15 years at the time of occurrence; that the petitioner taking advantage of the age of the victim girl had committed aggravated penetrative sexual assault on the victim girl. Further the petitioner used to threaten her, that he would kill her parents if she discloses the aforesaid occurrence. He further submitted that the investigation in this case is pending. Hence, he opposed for the grant of bail to the petitioner.

5. I have considered the submissions made on both sides and also gone through the statement recorded from the victim girl.

6. On perusal of the statement recorded from the victim girl, it revealed disturbing facts indicating that the petitioner, taking advantage of the loneliness of the victim girl, had committed aggravated penetrative sexual assault on the minor girl aged about 15 years.

7. Considering facts and circumstances of the case, grave nature of offence, investigation in this case is pending, the 183 BNSS statement of the victim narrates various disturbing facts and if the petitioner is enlarged on bail, there is possibility of hampering of the trial process, hence this Court is not inclined to grant bail to the petitioner at this stage.
