ORDER

The petitioner, who was arrested and remanded to judicial custody on 1/6

18.02.2025, for the alleged offence punishable under Section 392 of IPC, in Crime No.405 of 2018, on the file of the respondent police, seeks bail.

2. Earlier this Court in Crl.OP.No.29138 of 2025 dated 27.10.2025, after considering the bad antecedents of the petitioner and also the period of NBW pending, dismissed the bail petition of the petitioner by stating following reasons:

"6. Considering the fact that the earlier bail applications filed by the petitioner was dismissed by this Court on merits, and taking into account the bad antecedents of the petitioner as well as the fact that this is the third bail petition with no change in circumstances, this Court is not inclined to reconsider the same."

3. The learned counsel appearing for the petitioner submitted that even dismissal of earlier bail application there is no progress in the trial. Hence, he prays to grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that totally two accused in 2/6

this case, the petitioner is ranked as A1. The other accused/A2 is still absconding and hence the trial is not progress. However, he opposes to grant bail to the petitioner.

5. Considering the antecedents of the petitioner that 25 cases are pending against him and the petitioner is absconded for nearly five years, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.

6. However, the Trial Court is directed to expedite the trial process either to splitting up the case or by taking appropriate steps regarding the non-bailable warrant issued against A2, and to complete the trial as early as possible. 21.11.2025 drl To 1.The Inspector of Police, Krishnagiri Taluk Police Station, Krishnagiri District.
