ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.10.2025, for the alleged offence punishable under Sections 4(1)(c), 4(1)(A) of Tamil Nadu Prohibition Act amendment Act 2024, in Crime No.257 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner was found in possession of 36 liquor bottles each containing 180 ml and also 14 bottles each containing 750 ml. Hence the petitioner was arrested on 13.10.2025.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 13.10.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that the petitioner is having bad antecedents and 13 previous cases, investigation is pending. Hence, he strongly opposed for grant of bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions of the learned counsel on either side, the petitioner is having 13 previous cases and also the quantity of liquor bottles seized is also large in number and also if the petitioner is granted bail at this stage he will indulge in similar activities, this Court is not inclined to grant bail to the petitioner.
