Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, Directing the 7th and 8th respondnet to forthwith take action in accordance with lw on the representation of the petitioner dated 15.04.2021 with respect to the compensation payable to the acquisition of the petitioners land comprised in survey no 205/5 part, new survey No 205/5A part, the sub division survey No 205/5A12 Joint patta No. 567 measuring an extent of 11 sq. ORDER

This writ petition has been filed to direct the 7th and 8th respondents to forthwith take action, in accordance with law, on the representation of the petitioner dated 15.04.2021 with respect to the compensation payable to the acquisition of the petitioner's subject land.

2. Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondents.

3. By consent of the parties, the main writ petition has been taken up for disposal in the admission stage itself.

4. The learned counsel for the petitioners would submit that in this case, the petitioner had purchased the subject land vide sale deed dated 15.06.2011. Subsequently, vide newspaper publication dated 15.02.2021, the 7th respondent issued a public notice stating that the subject land is to be acquired for the purpose of widening Velachery Main Road. Thereafter, petitioner appeared before the respondent for enquiry and 3/7

raised objections. Further, he had also submitted a detailed representation dated 15.04.2021, requesting the respondents to give compensation for the subject land. However, the same was not considered by the respondents till date. Hence, this petition.

5. In reply, the learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation will be considered within a period of 6 weeks.

6. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and also perused the entire materials available on record.

7. In the case on hand, the petitioner had purchased the subject land vide sale deed dated 15.06.2011. Subsequently, vide newspaper publication dated 15.02.2021, the 7th respondent issued a public notice stating that the subject land is to be acquired for the purpose of widening Velachery Main Road. Thereafter, petitioner appeared before the respondent for enquiry and raised objections and also submitted a 4/7

detailed representation dated 15.04.2021, requesting the respondents to give compensation for the subject land. However, the same was not considered by the respondents till date.

8. In view of the above, the 7th and 8th respondents are directed to consider the petitioner's representation dated 15.04.2021, on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.

9. With the above directions, this writ petition is disposed of. No cost.
