This Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation in Crime No.140 of 2025, on the file of 3rd respondent/Inspector of Police, (H2) Police Station, Kirumampakkam, Puducherry, to 4th respondent/CB-CID, Puducherry or appoint a Special Officer to investigate the matter and file the final report before the competent Court within the time as may be stipulated by this Court.
2. The learned counsel for the petitioner would submit that the petitioner is the mother of the deceased Bakkiyalakshmi. He would submit that the deceased Bakkiyalakshmi was married to one Rajadurai on 08.06.2025 and after the marriage, the said Rajadurai left for Singapore, to work as a Machine Operator and the deceased was working as a Warden in a College at Puducherry. While so, the deceased died in a suspicious circumstance on 23.09.2025 and based on the complaint given by the petitioner, a case in Crime No.140 of 2025 was registered by the 3rd respondent police under Section 194 of BNSS. Later, the petitioner came to known from the room-mate of her daughter namely Ranjitha that her son-inlaw/Rajesh, had continuously given sex torture to her daughter and thereby, 2/6
she committed suicide. The room-mate Ranjitha had also given a statement stating that the son-in-law of the petitioner had continuously given sex torture to the daughter of the petitioner. However, the 3rd respondent police has not conducted a proper investigation with regard to the same. Therefore, the present petition is filed seeking transfer of investigation.

The learned Public Prosecutor (Puducherry) appearing for the respondents would submit that based on the complaint given by the petitioner that her daughter was found dead in a suspicious circumstance, the case was registered under Section 194 of BNSS and during the course of investigation, 14 witnesses have been examined and the post-mortem report suggests that it is a case of suicide. He would also submit that the further statement is yet to be recorded from the said Ranjitha. He would further submit that enquiry was also conducted by the Executive Magistrate/Deputy Tahsildhar since the death was within three months of marriage and concluded that it is not a case of dowry death. He would further submit that the investigation is going on in a proper manner.
4. Taking into consideration the facts and submissions of the learned Public Prosecutor (Puducherry), this Court feels that transfer of investigation to CB-CID is not warranted. However, a direction is issued to the Superintendent of Police, South (Pondicherry) to monitor the investigation being done by the 3rd respondent in Crime No.140 of 2025. 3/6
5. With the above directions, this Criminal Original Petition is disposed of.
