Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to consider the petitioner's application dated 07/05/2025 and to issue sub division patta in respect of lands measuring 18 cents situated at Kanniyam Village bearing survey No.98-4A, Tindivanam Taluk, Villupuram District.
***** COMMON ORDER All these writ petitions have been filed for a direction to the Tahsildar to deal with the online application submitted by the petitioners, wherein, the petitioners are seeking for issuance of patta/sub division patta/transfer of patta after conducting survey.
2. Heard the learned counsel appearing on either side.
3. In all these cases, the petitioners are relying upon certain title documents and also the earlier patta that was issued in the name of the predecessor in title or in the name of their family members. In some of the cases, except for the title documents, no patta is available. Under 3/7
such circumstances, online application has been submitted by the respective petitioners seeking issuance of patta/sub division patta/transfer of patta.
4. Taking into consideration the facts and circumstances of the case and without going into the merits of this case, there shall be a direction to the concerned Tahsildar to deal with the online application on its own merits and in accordance with law after affording opportunity to all interested parties and pass final orders, within a period of eight (8) weeks from the date of receipt of copy of this order.
5. This order will apply only to those cases where online application has been made seeking issuance of patta/sub division of patta/transfer of patta. Even representation can be considered wherever such direction has been issued by the Collector to the Tahsildar when such application have been submitted to the concerned District Collector during the Public Grievance Day.
6. The above order will not apply in cases where civil suits are pending between the parties and in such cases, it is left open to the Tahsildar to intimate the parties to workout the remedy before the Civil 4/7
Court and depending upon the result of the case, to approach the Revenue Department seeking for issuance of patta/sub division patta/transfer of patta.
All these writ petitions are disposed of in the above terms. No Costs.
