ORDER

This petition has been filed seeking a direction to the respondents No.5 to 7 to implement the order dated 3.01.2024 vide proceedings in letter No.Uu.Poo/ Ko.Mudhalvar Mukavari/2 M/ 2024 on the file of 2nd respondent regarding the disconnection of free agricultural electricity service connection granted in favour of respondents No.8 and 9 bearing Nos.28 T.F-V-5 plus 5 (10HP) and 93-T.F.V(10HP).

It is the case of the petitioner that the petitioner is the owner of the agricultural land measuring to an extent of four acres and cents comprising in S.Nos.21, 22, 23 situated at East Komaralingam Village, Madathukulam Taluk, Tiruppur District. The petitioner is an agriculturist and the respondents 8 & 9 are not ayacutdars and had obtained two free agricultural electricity service connections from the respondents. Without obtaining any permission, they erected pipelines and extracted water from the PAP water canal using free current. Representation made before the respondents. Inquiry conducted and found that the respondents 8 & 9 shall execute affidavit stating that they will not

use the free agricultural electricity for extracting water. Subsequently, the 9 th respondent filed another writ petition to recognise the water pipelines and the same was disposed giving liberty to him for making a fresh representation. Once against the respondents in violation of their own affidavit of undertaking have been extracting water using free agricultural electricity. Again, the petitioner made a representation to the respondents. Based on which, enquiry has been conducted and found that the respondents 8 & 9 are illegally extracting water using free electricity. Therefore, recommended disconnection of the electricity service. Till date, the said order is not implemented. Hence, the petitioner made a representation to the official respondents for implementing the order of the second respondent and the same is not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Government Counsel appearing for the official respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. The learned counsel for the private respondents submitted that this Court may direct the official respondents to implement the order only after providing opportunity to them.

6. Heard the learned counsel for both side and perused the materials available on record.

7. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondents 5 to 7 to implement the order passed by the second respondent after providing opportunity to the petitioner as well as the private respondents within a period of four weeks from the date of receipt of a copy of this order.

8. With the above directions, the writ petition is disposed of. No costs.
