The petitioner, who apprehends arrest for the alleged offence under Sections 318(4) of BNS (Sections 420 of IPC) r/w Section 15&15(3) of Indian Medical Council Act, 1956 in Cr.No.422 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, who is a Homeopathy Doctor, has been practicing Allopathy without registration before the Medical Council, thereby cheating the general public. Hence, the competent authority has lodged the present complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is a Homeopathy Doctor and has not been practicing Allopathy, and that he has been falsely implicated in this case. Hence, he prays that anticipatory bail may be granted to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the 2/4

investigation is still pending, and that the petitioner does not possess the qualification required to practice allopathy. Hence, he vehemently opposed the grant of anticipatory bail.

5. Heard both sides and perused the materials available on record.

6. Considering the submissions made and also the fact that, if the petitioner is granted anticipatory bail, he may continue to engage in similar activities which could endanger the general public, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 19.11.2025 Vv 3/4
