ORDER

The petitioners, who were arrested and remanded to judicial custody on 14.10.2025, for the alleged offence punishable under Sections 7(5), 20(2) of COTPA Act r/w 123 of BNS,, in Crime No.400 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against these petitioners is that, these petitioners are ranked as A1 and A2, who were joined hands with other four accused involving transportation of banned tobacco products of 334 kgs from Karnataka to Tamil Nadu and they were intercepted and the police have seized the property. Hence this case.

3. Learned counsel appearing for the petitioners submitted that the petitioners are an innocent person and they have been falsely implicated in this case. He would further submit that the petitioners were arrested and he is in judicial custody from 14.10.2025 and ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that the petitioners are 2/4

illegally transported the products from Karnataka to Tamil Nadu and huge quantity seized in this case, investigation is pending, and opposed for grant of bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the co-accused still absconding, investigation is pending, quantity is also huge quantity, this Court is not inclined to grant bail to the petitioners.
