O R D E R
The present Writ Petition has been filed seeking a direction to the respondents 1 to 3 herein to pass order in the proceedings in Na.Ka.No.3952/2023/A3 dated 12.02.2024 and considering the petitioner's representation dated 24.04.2023 and delete the respondents 4 to 9 from the house of the petitioner.
2. Heard both sides. With the consent of both sides, the present Writ Petition is taken up for hearing at the admission stage itself. Since no adverse orders has been passed as against the respondents 4 to 9, notice to them is dispensed with.
3. The learned counsel for the petitioner submitted that the petitioner made a representation to the first respondent to delete the names of the respondents 4 to 9 from his residential address in the voters' list as they are living separately for more than 18 years, for which the third respondent issued summons to both the parties for enquiry. He further submitted that despite pending enquiry in regard to his objections for the voters list, in the voters list, the names of the respondents 4 to 9 were shown in the petitioner's address and hence, the present Writ Petition.
4. Considering the facts and circumstances of the case, this Court directs the third respondent to conclude the enquiry on the petitioner's representation dated 24.04.2023, after affording opportunity of hearing to the
petitioner as well as the respondents 4 to 9 and any other interested parties, in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this Order. There shall be no orders as to costs. 13.11.2025 Index: Yes/No NCC : Yes/No Order : Speaking/Non Speaking DP
