This petition filed under Section 528 of BNSS to relax the condition imposed in Para 3 by this Honble Court in Crl.M.P.No.13262 of 2025 in Crl.M.P.No.2953 of 2025 in Crl.M.P.No.16168 of 2025 in Crl.A.No.955 of 2023 dated 18.07.2025.

ORDER

(Order of the Court was made by N.Sathish Kumar J.) This Criminal Miscellaneous Petition has been filed seeking relaxation of the condition imposed by this Court while granting bail.

2. The learned counsel for the petitioner would submit that originally bail was granted to the petitioner with a condition that the petitioner shall stay at Chennai and report before the respondent office at Chennai, every day at 10.30 a.m., except on Mondays and the hearing dates until further orders. Subsequently, the said condition has been modified, and now, the petitioner is

signing before the Tiruvidaimaruthur Police Station on every second and fourth Sundays of the month at 10.30 a.m.,and is appearing before the Special Court, Poonamallee, on the first working day of every month at 10.30 a.m. Since the petitioner is unable to join any permanent job to eke out his livelihood, he is seeking relaxation of the condition.

3. The learned Special Public Prosecutor appearing for the respondent would submit that except the official witnesses, all other witnesses have been examined. Hence, he has no serious objection for relaxation of the condition to the effect that the petitioner shall appear before the Trial Court on the first working day of every month and on all the hearing dates fixed by the Trial Court.

4. Considering the said submission and the fact that trial has already commenced, the condition is modified to the effect that the petitioner shall appear before the Trail Court on the first working day of every month and on all the hearing dates fixed by the Trial Court without any default.

5. Other conditions shall remain unaltered.
