O R D E R

This Criminal Original Petition has been filed seeking to quash the FIR in Crime No.3034/2020 on the file of the 1st respondent.

2. Learned counsel for the petitioner would submit that the petitioner is a practising Advocate. Since he questioned the activities of the respondent police, he has been falsely implicated in this case. He would further state that taking into consideration that there are no materials as against the other accused viz., A4 & A7, the proceedings in respect of them has been quashed by this Court in Crl.O.P.No.3802 of 2022 vide order dated 10.07.2023 and the petitioner is also a similarly placed person.

3. Learned Government Advocate(Crl.Side) would submit that a final report was filed before the Judicial Magistrate, Ponneri on 01.08.2020 as against 11 accused persons and the final report is yet to be taken on file.

In the considered view of this Court, there are no allegations against the petitioner and considering the fact that the petitioner is a practising Advocate and the continuation of the criminal proceedings will have a serious impact on his future, this Court is inclined to interfere with the FIR insofar as the petitioner is concerned. The continuation of the criminal proceedings against the petitioner will amount to an abuse of process of law 2/4

which requires interference of this Court in exercise of its jurisdiction under section 482 of Cr.P.C./Section 528 of B.N.S.S.

5. In the light of the above discussion, the FIR in Crime No.3034/2020, on the file of the first respondent is quashed insofar as the petitioner is concerned. The first respondent shall bring this order to the notice of the learned Judicial Magistrate, Ponneri, and the learned Judicial Magistrate, Ponneri, shall act upon the final report insofar as the other accused persons are concerned and proceed further in accordance with law.
