This Civil Revision Petition has been filed to direct the District Munsif cum Judicial Magistrate, Pallavaram to dispose of E.P.No.50 of 2025 in RLTOP.No.74 of 2023 in a time frame accordance with Section 1/4

39(3) of the Tamil Nadu Regulation of Rights and Responsibilities of Landlord and Tenants Act, 2017.

2. Heard Mr.R.Chandra Sudan, the learned counsel for the revision petitioner.

3. The revision petitioner is the landlord, who has successfully obtained an order of eviction in RLTOP.No.74 of 2023. The revision petitioner has also put the decree in execution proceedings in E.P.No.50 of 2025 before the District Munsif cum Judicial Magistrate, Pallavaram. The respondent/tenant has also entered appearance and did not even file a counter-affidavit. The grievance of the petitioner is that the said Execution Petition is not disposed of despite being ripe for enquiry and further the petitioner is aged about 91 years. Even under the Tamil Nadu Regulation of Rights and Responsibilities of Landlord and Tenants Act, 2017, the execution petition is to be disposed of within a period of 30 days.

4. In the light of the above, I am inclined to dispense with notice to the respondent and also direct the learned District Munsif cum Judicial Magistrate, Pallavaram to dispose of E.P.No.50 of 2025 in RLTOP.No.74 of 2023 on or before 05.12.2025 on merits and in accordance with law.
