ORDER
This writ petition has been filed for a direction directing the respondents to consider the petitioner's representation dated 14.10.2025 seeking subsistence allowance.
2. The petitioner was appointed as Secretary in the second respondent society. While being so, he was suspended from service for the misappropriation committed by the petitioner to the tune of Rs.3 Crores. Thereafter, the enquiry officer was appointed to conduct domestic enquiry. However, on receipt of the notice from the enquiry officer, the petitioner failed to appear before the enquiry officer. Thereafter, on 11.05.2021 the resolution was passed by the society. Subsequently, as per the resolution passed by the society, the petitioner was once again reinstated into service and on the same day, he was suspended from service. Thereafter, the petitioner was served with a charge memo consisting four charges. The petitioner was also served with a charge memo. However, the petitioner did not submit any explanation and failed to appear for enquiry. Therefore, if the petitioner appears before the first respondent, the request of the petitioner will be considered.

3. In view of the above, the petitioner is directed to appear before the first respondent and participate in the enquiry. Thereafter, the first respondent is directed to consider the request made by the petitioner seeking subsistence allowance on merits and in accordance with law.
