ORDER

This writ petition is filed to call for the records relating to the order of termination from service passed in proceedings No.224/PRTC/Admin/PF/2015/909 dated 31.10.2025 on the file of the 1st Respondent quash the same and direct the respondents to reinstate the petitioner in service with all attended benefits.

2. The case of the petitioner is that he was appointed as Conductor in the respondent's Transport Corporation on contractual basis in the year 2015, through employment exchange. In the year 2025, the petitioner was issued with a charge memo alleging that he is spreading false and defamatory news against the corporation, for which, the petitioner has submitted his explanation on 23.05.2025, but the same was not accepted by the respondents.

3. It is the further case of the petitioner that he has appeared before the enquiry officer and during the enquiry proceedings, no witness was examined and no document was marked. This being so, on 11.10.2025, the third

respondent issued a show cause notice, since the enquiry officer held that the charges against the petitioner are proved. For the said show cause notice, the petitioner has submitted his explanation. However, without considering the same, the first respondent passed an order dated 31.10.2025, awarding the punishment of termination service. Challenging the same, the present writ petition is filed.

4. Learned counsel for the petitioner would submit that the petitioner was illegally terminated by the first respondent without conducting any disciplinary proceedings, which is not sustainable. Therefore, he prayed this Court that liberty may be granted to the petitioner to work out the remedy before the appropriate Authority and issue direction to the appropriate Authority to pass appropriate orders within a reasonable time frame and grant further liberty to the petitioner to approach the Labour Court, if any adverse order is passed by the appropriate Authority, and issue direction to the Labour Court to pass appropriate orders within a reasonable time frame.

Considering the request now made by the learned counsel for the petitioner, this Court permits the petitioner to work out the remedy before the appropriate Authority, within a period of two weeks from the date of receipt of a copy of this order and on such approach by the petitioner, the concerned Authority is directed to consider the same and pass appropriate orders within a

period of six weeks thereafter and if any adverse order is passed by the said Authority, further liberty is granted to the petitioner to approach the competent Labour Court. If any dispute is raised by the petitioner before the Labour Court, the Labour Court is directed to consider the same and dispose of the same, within a period of six months from the date of the dispute. With the above liberty and directions, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 23-02-2026 Index: Yes/No Speaking/Non-speaking order VM
