This Criminal Original Petition is filed under Section 482 of BNSS to enlarge the petitioners on anticipatory bail in the event on their arrest by the respondent police in Cr.No.273 of 2025 on the file of the Inspector of Police,Tiruvannamalai Taluk Police Station, Thiruvannamali, Thiruvannamalai District.

ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNSS, 2023, and Section 21(1) of Mines & Mineral (Development & Regulation) Act, 1957 in

connection with the Cr. No.273 of 2025, seek anticipatory bail.

2. The case of the prosecution is that on 09.10.2025, Assistant Director, Regional flying squad (Mines) Villupuram and Assistant Geologist/Manjunathan, conducted vehicle checkup and found the petitioner transporting 5 unit of gravel sand in a Tata Taurus lorry bearing Reg.No.TN-11, AK-1145 without any valid permit. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent and no way connected with the alleged offence, and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and on instructions submitted the respondent police seized the vehicle and 5 units of gravel sand from the accused, the investigation in this case is at initial stage and two criminal cases similar in nature are pending against the petitioner. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the submissions made by the learned counsel appearing on either side, the nature of offence, petitioner is having two previous

case similar in nature and stage of investigation, I am not inclined to grant the anticipatory bail to the petitioners.
