ORDER

The petitioners who apprehend arrest for the alleged offences under Sections 303(2), 326(a) of BNS Act 2023 & Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.275 of 2025 on

the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners were involved in illegal transportation of 1 unit of savudu sand in a JCB bearing Registration No. AP 03 BL 8985 without any valid permit. Hence, the case has been registered.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and falsely implicated in this case. He further submitted that the petitioners are ready and willing to furnish substantial sureties and to abide by any conditions that may be imposed by this Hon'ble Court and therefore, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the anticipatory bail to the petitioners, reiterated the prosecution case and states that the quantity of savudu sand involved in this case is 1 unit; and that the investigation is pending.

5. Considering the nature of allegations, the submissions made by learned counsels on either side, and considering the fact that the petitioners are not only illegally quarried Waste sand but also caused damage to the ecology, therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
