Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the entire records relating to the proceedings No.6205/SaPi(OoNa)5/Ma.Po.Ka./2024 dated 04.04.2025 of the second respondent and quash the same and consequentially to revoke the suspension order dated 21.05.2024 and allow the petitioner to retire from the service with all his retirement benefits. This writ petition has been filed challenging the order dated 04.04.2025 passed by the second respondent, thereby rejecting the request made by the petitioner to revoke the order of suspension dated 21.05.2024.

2. Heard the learned counsel for both sides and perused the materials available on record.

The petitioner, while working as a Deputy Manager, Chrompet (Technical), was charged as an accused in Crime No.441 of 2025 for the offences punishable under Sections 109, 120B, 465, 468, 471, 420 and 201 of IPC and under Sections 7, 12, 13(2) r/w 13(1) of the Prevention of Corruption Act, 1988. He was also implicated in Crime No.344 of 2018 for the offences punishable under Sections 7, 12, 13(2) r/w 13(1) of the Prevention of Corruption Act, 1988, alleging that he had received a huge sum of money for providing employment and that the case involved job rocketing. The investigation has been completed and the final report has been filed; however, cognizance has not yet been taken by the Trial Court. In the meanwhile, the petitioner was suspended from service and he was not allowed to retire from service. Therefore, the petitioner submitted a representation to revoke the order of suspension in the light of G.O. (Ms).No.81, Human Resources Management (N) Department, dated 04.08.2022. The request made by the petitioner was rejected the order impugned in this Writ Petition.

4. The petitioner is alleged to have committed very serious offences and was involved in a case of job rocketing, having received a huge sum of money along with other accused persons. Therefore, the order of suspension cannot be interfered with at this stage and the request made by the petitioner for revocation of the suspension order was rightly rejected. However, though the criminal case is pending, there is absolutely no impediment for the respondents to proceed with the disciplinary proceedings.

In view of the above, the second respondent is directed to complete the disciplinary proceedings and pass orders on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order. It is needless to state that the petitioner is entitled to all the documents annexed to the charge memo. 4/6

6. With the above directions, this Writ Petition is disposed of. Consequently, the connected Miscellaneous Petitions are closed. No costs. 21.11.2025 Index:Yes/No kv To
