ORDER

This application is filed by the applicant / fourth defendant to condone the delay of 73 days in filing the written statement of the applicant / second defendant in

C.S.No.333 of 2019.

2. According to the applicant, he is the fourth defendant in the main suit, there is a delay of 73 days in filing the written statement. The reasons stated in the affidavit is that the applicant was unable to obtain the copies of the documents and unable to file written statement, therefore, filed this present application.

3. The learned counsel for the respondents seriously objected to allow this application.

4. Considering the above said rival submissions made by the parties and considering the number of days delay and in order to give fair chance to the fourth defendant to defend the case to meet the ends of justice, this Court is inclined to allow this application.

5. Accordingly, this application is allowed and the delay of 73 days in filing
