Writ Petitions filed under Article 226 of Constitution of

India, praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the notification dated 09.10.2025 issued for direct recruitment to the post for Village Panchayat Secretary through employment exchange issued by the 4th respondent and to quash the same in so far as the category classified under General for the legal heirs of Freedom Fighters without adherence to the priority preference including age relaxation as illegal and violation of Article 14, 19, 21 of the Constitution of India and G.O. (Ms) No. 122 dated 02.11.2021 and G.O.No.59 dated 04.05.1999 and consequently direct the respondents to fix age limit as which has been given for Exservicemen for the post. For Petitioner : Mr. R. ORDER

This Writ Petition has been filed challenging the notification dated 09.10.2025 issued by the fourth respondent for direct recruitment to the post of Village Panchayat Secretary.

The petitioner, who is a B.E. Graduate aged about 43 years, has challenged the notification dated 09.10.2025 of the fourth respondent for recruitment to the post of Village Panchayat Secretary, contending that the said notification is violative of Articles 14, 19 and 21 of the Constitution of India, as

well as G.O.No.59 dated 04.05.1999 and G.O.(Ms).No.122 dated 02.11.2021. 3.

The learned counsel for the petitioner submitted that the petitioner is a grandson of Freedom fighter. He contended that the fourth respondent has granted age relaxation for Ex-Servicemen between 18 and 55 years, whereas for the General Category, the age limit is 18 to 32 years. It is further submitted that except for an interview, no other mode of selection has been mentioned in the impugned notification for the above said post. 4.

Heard the learned counsel for the petitioner and the learned Additional Government Pleader and perused the materials available on record. 5.

Admittedly, the learned counsel for the petitioner is a grandson of freedom fighter and he is not an Ex-Serviceman and therefore cannot claim any benefit under that category. Since the petitioner is aged about 43 years, he is barred by age. Though the minimum educational qualification prescribed is only 10th STD, the petitioner is a B.E. graduate. Therefore, the petitioner cannot claim relaxation either on the ground of age or under any special category. 6.

Further, it is seen that the petitioner completed is graduation at the

age of 22 years. After a lapse of more than 23 years, he has now challenged the notification for recruitment of Village Panchayat Secretary post, which clearly reflects lack of diligence, and as such, the Writ Petition challenging the notification for recruitment for the post of Village Panchayat Secretary is devoid of merits.
