This Transfer Civil Miscellaneous Petition is filed seeking to withdraw the H.M.O.P.No.3922 of 2025 on the file of the V Additional Family Court at Chennai and transfer the same to the Family Court at Villupuram.

2. The Transfer is sought for by the petitioner/wife on the ground that she is residing in Villupuram with her parents. It is her grievance that she finds it very difficult to travel 230 Kms., from Villupuram to Chennai for every hearing. She is depending entirely on her father for her expenses and therefore, she is not able to spend money for travel for every hearing. Since the matter is before the Family Court, the presence of the parties is mandatory. Further, the respondent/husband is not paying any maintenance to her.
3. Heard the learned counsel for the petitioner and the learned counsel for the respondent and perused the materials available on record.
4. On perusal of case records, it appears that the husband who is the resident of Chennai has taken out petition for restitution of conjugal rights and it is pending before the V Additional Family Court, Chennai in H.M.O.P.No.3922 of 2025.
5. In consideration of the above said details, the request of the petitioner herein / wife appears to be justifiable cause and accordingly, 2/4
this Transfer Civil Miscellaneous Petition is allowed. Sequel to this, H.M.O.P.No.3922 of 2025 pending on the file of the V Additional Family Court, Chennai is withdrawn and transferred to the file of the Family Court at Villupuram. The Family Court, Villupuram shall take effective steps to dispose of the matter in accordance with law at the earliest. No Costs.
