Prayer : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent (Revenue Divisional Officer), Tirupattur, relating to the impugned order dated 28.02.2025 and quash the same as illegal, arbitrary and obtained by suppression and fraud, and consequently directing the first respondent (District Revenue Officer), Tirupattur District, to dispose of the petitioner's statutory appeal dated 22.05.2025 within a time bound period of 15 days, after affording due opportunity of hearing to both parties and pass orders. ORDER
This writ petition has been filed challenging the proceedings of the second respondent dated 28.02.2025 and for a consequential direction to respondents 1 to 3 to cancel the patta that has been issued in the name of the fourth respondent and to issue patta in the name of the petitioner.
2. Heard Mr.K.Shahul Hameed, learned counsel appearing for the petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing for respondents 1 to 3.

3. It is seen from the records that already an appeal has been filed before the first respondent, and the first respondent had issued notice to the parties to attend the enquiry. The same is evident from the summons which has been signed by the first respondent on 10.07.2025. Therefore, it will be more appropriate for the petitioner to work the remedy before the first respondent.
4. In the light of the above discussion, there shall be a direction to the first respondent to hear the parties, give them an opportunity and thereafter, pass final orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
