(The Order of the Court was made by P.Velmurugan,J) Since the Criminal Appeal against the conviction of the prisoner, is pending before this Court in Crl.A.No.126 of 2021 and when there is enabling provision under Section 389 Cr.P.C. to seek suspension of sentence pending the Criminal Appeal, the prisoner is at liberty to work out his remedy before this Court where the Criminal Appeal of the prisoner is pending. not to be entertained, and the same is accordingly dismissed. The miscellaneous petition is closed.
