ORDER
The petitioner, who was arrested and remanded to judicial custody on 1/7
21.08.2025, for the alleged offence punishable under Section 123 of BNS Act, in Crime No.516 of 2025, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was found to be in illegal possession of 66 number of tablets of Aspadol. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody from 21.08.2025. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed bail, submitting that the petitioner along with other accused, illegally administered two tablets of Aspadol to the victim in powdered form by syringe. During the act, the needle tip broke and remained lodged in the victim's right hand, causing severe pain, after which the petitioner filed. The victim was admitted to the hospital and later discharged. He further submitted that the petitioner has four previous cases.
5. Earlier, this Court dismissed the bail petitions filed by the petitioner in Crl.OP.Nos.26572 & 28772 of 2025 dated 26.09.2025 & 23.10.2025 on the 2/7
ground of illness and also considering of previous antecedents. This is the successive bail petition.
6. When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) submitted that now the final report in this case was filed.
7. Considering the above facts and circumstances of the case, the fact that the petitioner is in custody from 21.08.2025 and that the final report filed and though previous cases are cited, this Court is inclined to grant bail to the petitioner.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Tiruppur, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall report before the concerned 3/7
Court daily at 10.30 a.m., for a period of four weeks and thereafter as and when required for interrogation. [c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble 4/7
Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
