ORDER

This writ petition has been filed by the petitioner seeking to direct the 2 nd respondent to receive the petitioner's cancellation of Power of Attorney Deed dated 16.10.2025 and thereby, to register the same. 2.Mr.Abishek Murthy, learned Government Advocate, takes notice on behalf of the respondents. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the petitioner

executed a General Power of Attorney in favour of one Anbalagan and his wife Thamilselvi vide Doc.No.17/2008 dated 05.03.2008. Sine the said Anbalagan died on 09.02.2021 and the petitioner also decided to take care of the property on his own, she intend to cancel the said Power of Attorney and prepared a deed of cancellation of Power of Attorney and applied for registration through online on 16.10.2025 and she was also given temporary registration No.TP/236581115/2025 vide serial No.11 (D511). When the petitioner appeared nd respondent orally refused to register the same and for registration, the 2 insisted for order from the Court for cancellation of Power of Attorney. Hence, the present writ petition has been filed.

4.Learned Government Advocate appearing for the respondents would submit that the petitioner has not present the cancellation of Power of Attorney Deed dated 16.10.2025 till date. Since the document is not at all presented by the petitioner, refusal will not come into picture. In the event, the petitioner nd presented the said cancellation deed, the same will be scrutinized and the 2 respondent will proceed further in accordance with law.

5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondents. 6.Considering the submissions made by either parties, this Court is of the view that as rightly contended by the learned Government Advocate, the refusal will come into picture only when the cancellation deed is presented and same got rejected through the refusal check slip in writing. In the present case, based on the oral communication, the petitioner failed to present the cancellation deed. Hence, the petitioner is directed to present the cancellation of Power of Attorney Deed dated 16.10.2025 for registration as per the prescribed procedure and in nd respondent is directed to register the same forthwith, if it is which case, the 2 otherwise in order, after issuing notice to the Power Agent. 7.With the above direction, this writ petition is disposed of. No costs.
