O R D E R

The petitioner, who was arrested and remanded to judicial custody on 03.07.2025 for the alleged offence under Sections 8(c), 20(b)(ii)(C) and 29(1) of NDPS Act, 1985 in Crime No.108 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, along with the other accused, was found in joint possession of 22 kgs of ganja, which is a commercial quantity, leading to the registration of the FIR. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in this case. He further submitted that the petitioner has been in custody from 03.07.2025 and that he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner's earlier bail petition was dismissed by this Court by order dated 23.10.2025 in Crl.O.P.No.28725 of 2025. He further submitted that, without any change in circumstances, the present petition has been filed. Hence, he vehemently opposed the grant of bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record.

6. Taking into consideration the gravity and nature of the offence alleged against the petitioner and the fact that there is no change in circumstances after the dismissal of the petitioner's earlier bail petition, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed. 18.11.2025 Vv To
