Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned letter issued by the 3rd respondent dated 19.09.2025 in letter No.32/7032/T5/TNSTC(V)/2025 and to quash the same, consequently, directing the respondents to pay the subsistence allowance for the entire suspension period and backwages till forthwith.
For Petitioner : Mr.C.Prabakaran For Respondents : Mrs.S.Pavithra Standing Counsel O RDER This Writ Petition has been filed challenging the order passed by the third respondent dated 19.09.2025, thereby directing the petitioner to come to legal section to receive the subsistence allowance.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner joined the respondents' Corporation as a Driver. While being so, there was a complaint against the petitioner and the petitioner was suspended from service on 03.01.2025. Subsequently, the petitioner was also issued with a charge memo. Thereafter, he was reinstated into service on 16.01.2025. Once again, the petitioner was suspended by an order dated 21.01.2025 and the petitioner was issued with charge memo on 22.01.2025. Thereafter, the petitioner submitted a representation for revocation of his order of suspension. Further, the petitioner was not paid any subsistence allowance.

While being so, the petitioner was served with an order dated 19.09.2025, stating that the petitioner's suspension order was already revoked on 11.04.2025 and even then, the petitioner failed to report duty. Therefore, the petitioner was directed to come to the legal section to receive the subsistence allowance to the tune of Rs.33,997/-.
5. The learned counsel for the petitioner submits that though the petitioner approached the respondents, he was not permitted to join duty and no work was allotted to him.
6. On instructions, the learned Standing Counsel appearing for the respondents submitted that if the petitioner reports to the office of the third respondent, he will be assigned duty.
7. In view of the above, the petitioner is directed to appear before the third respondent and on his appearance, the third respondent is directed to allot duty to the petitioner by paying subsistence allowance in accordance with law. Further, the petitioner shall co-operate for the enquiry on the charge memo served on him.
8. With the above directions, this writ petition stands disposed of. Consequently, connected Miscellaneous petition is closed. No costs. 14.11.2025 Internet: Yes Index : Yes/No Speaking/Non Speaking order mn
