2. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent.

3. Considering the facts and circumstances of the case, the petitioner is at liberty to approach the Labour Court by filing an application seeking withdrawal of the deposited amount of back wages.

4. On receipt of the same, the Labour court shall decide the same on its own merit.

5. Accordingly, this writ miscellaneous petition is closed. K.SURENDER J.
