ORDER
This petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, (hereinafter referred to as the Act) for appointment of a Sole arbitrator under the Dealership agreement dated 20.07.2007 to resolve the dispute between the parties.

Heard Mr.Sundarapandiyan, learned counsel for the applicant and Mr.Mohammed Fayaz Ali, learned counsel for respondent.

The case of the applicant is that he entered into a dealership agreement dated 20.07.2007 with the respondent. The grievance of the applicant is that the respondent corporation stopped the supply of Petrol and Diesel to the applicant agency. Hence, the petitioner has invoked arbitration clause available in clause 62(a) of the agreement dated 20.07.2007 and the trigger notice was issued under Section 21 of the Act on 22.10.2025.

In the considered view of this Court, there is a valid agreement between the parties in line with Section 7 of the Act and it also provides for an arbitration clause. All the other issues both on facts as well as on the arbitrability of the disputes can be raised before the Sole Arbitrator and the same will be considered on its own merits and in accordance with law.

In the light of the above discussion, this Court appoints Mr.Abudu Kumar Rajarathinam, Senior Advocate, at Parvathy Nilayam, No.7, Moores Road, Greams Road post office, Chennai - 600 006, Mobile Noo.9884014991, as the sole Arbitrator and the sole Arbitrator is requested to adjudicate the arbitral disputes that had arisen between the parties and render arbitral award by holding sittings in the 'Madras High Court Arbitration Centre under the aegis of this Court' (MHCAC) as per Madras High Court Arbitration Proceedings Rules 2017 and fee of Sole Arbitrator shall be in accordance with the Madras High Court Arbitration Centre (MHCAC) (Administrative Cost and Arbitrator's Fees) Rules 2017.
