Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus, directing the 1st and 2nd Respondent to initiate appropriate action against the 3rd respondent based on proceedings of the 5th respondent vide Na.Ka.No.A.KA.May.MA/001/2025 dated 30.09.2025 and dated 15.10.2025 for aiding the 6th Respondent Mr.J. Krishnamoorthy, illegally interfering with the lawful business, operations of the petitioner's government licensed cable TV network "Sam Cable Vision Network" under L.C.O. 103378, within a time frame as may be fixed by this Court. This Writ Petition has been filed seeking a direction to the first and second respondents to take appropriate action against the third respondent for not registering any case on the complaint lodged by the petitioner. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the first and second respondents. Perused the materials available on record.
3.The petitioner is running a cable TV business. In this regard, there is a dispute between the petitioner's family and the sixth respondent, who is none
other than the petitioner's own brother. There were quarrel between them and pursuant to the complaint lodged by the sixth respondent, an FIR has been registered in Crime No.505 of 2025 for the offences punishable under Sections 294, 118 and 351(2) of Bharatiya Nyaya Sanhita, 2023 as against the petitioner, her husband and two others, by the Inspector of Police, Vepery Police Station, Kizhpakkam, Chennai. Further, if no action was taken on the complaint lodged by the petitioner, the petitioner ought to have approached the superior officers seeking registration of the FIR and thereafter the competent Court, in the manner known to law. Therefore, for the alleged non-registration of the FIR, no action is warranted as against the third respondent. 4.In view of the above, this writ petition lacks merit and is liable to be dismissed.
