ORDER
(Order of the Court was made by N.Sathish Kumar J.) This Criminal Miscellaneous Petition has been filed seeking relaxation of the condition imposed by this Court while granting bail.
2. The learned counsel for the petitioner would submit that originally bail was granted to the petitioners with a condition that the petitioners shall stay at
Chennai and appear before the Trial Court on on every working day at 10.30 a.m., until completion of trial. Subsequently, the said condition has been modified, and now, the petitioners 1 to 6 are signing before the Tiruvidaimaruthur Police Station and the 7 th petitioner is signing before the Tenkasi Police Station, on every second and fourth Sundays of the month at 10.30 a.m.,and are appearing before the Special Court, Poonamallee, on all hearing dates. Since the petitioners are unable to join any permanent job to eke out their livelihood, they are seeking relaxation of the condition.
3. The learned Special Public Prosecutor appearing for the respondent would submit that except the official witnesses, all other witnesses have been examined. Hence, he has no serious objection for relaxation of the condition to the effect that the petitioners shall appear before the Trial Court on the first working day of every month and on all the hearing dates fixed by the Trial Court.
4. Considering the said submission and the fact that trial has already
commenced, the condition is modified to the effect that the petitioners shall appear before the Trail Court on the first working day of every month and on all the hearing dates fixed by the Trial Court without any default.
5. Other conditions shall remain unaltered.
