This petition is filed to condone the delay of 113 days in filing the above Civil Miscellaneous Appeal.

2. In view of the endorsement made by the learned counsel for the appellant, notice to the 1st respondent is dispensed with.

3. Though the name of the 2nd respondent is printed in the cause list after due service of notice, there is no representation on their side.

4. This court is satisfied with the reasons attributed in the affidavit filed in support of this petition. Hence, this petition is ordered.

5. The Registry is directed to number the above Civil Miscellaneous Appeal, if it is otherwise in order, and list the same in the ususal course.

6. It is made clear that the petitioner will not be entitled to any interest for the default period, if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
