Ms.J.R.Archana, Government Advocate (Crl.Side) COMMON ORDER C.M.P.Nos.22264 & 22267 of 2025 have been filed by the defacto complainant seeking cancellation of anticipatory bail granted to the private respondents (Bail petitioners) in Crl.O.P.Nos.13115 & 13116 of 2024, on the ground that they have not complied the conditions imposed by this Court. Crl.M.P.Nos.24212 of 2025 & 302 of 2026 have been filed by the bail 3/12
petitioners seeking modification of the condition imposed on them, on the ground that they were not able to appear before the respondent as ordered by this Court in Crl.O.P.Nos. 13115 & 13116 of 2024.

The learned counsel for the petitioner/defacto complainant submitted that this Court originally granted interim anticipatory bail to the petitioners/A2 to A5 in Crl.OP.Nos.13115 & 13116 of 2024 by common order dated 21.06.2024 with a condition to deposit a sum of Rs.40 lakhs to the credit of crime number within a period of two weeks from the date of receipt of a copy of this order and the defacto complainant is permitted to withdrew the same and the petitioners/A2 to A5 shall report before the respondent police on every Saturday at 10.00 a.m., for the period of four weeks. However, they have failed to comply the conditions and continuously, they obtained time for depositing the same. Subsequently, final order has been passed separately. 2a. This Court while passing final order in Crl.O.P.No.13115 of 2024, dated 12.09.2024, modified the deposit condition imposed on the petitioners/A2 & A3 to deposit a sum of Rs.10 lakhs to the credit of crime number within a period of two weeks from the date of copy of order and 4/12
remaining amount of Rs.10,00,000/- shall be paid on or before 15.10.2024; and the petitioners/A2 & A3 are directed to deposit the title deed in Doc.No.10887/2008, dated 05.09.2008 registered before the Joint SubRegistrar-I, Arakonam within a period of two weeks from the date of receipt of copy of this order and also the petitioners shall report before the respondent police on every Saturday at 10.00 a.m., for the period of four weeks. 2b. The final order in Crl.O.P.No.13116 of 2024, dated 12.09.2024, the petitioners/A4 & A5 are directed to report before the respondent police on every Saturday at 10.00 a.m., for the period of four weeks. Subsequently, the petitioners/A2 & A3 in Crl.O.P.No.13115 of 2024 have deposited the aforesaid money as ordered by this Court vide order dated 12.09.2024.
However, all the petitioners/A2 to A5 have not complied with a condition that they shall appear before the respondent police on every Saturday at 10.00a.m., for the period of four weeks, for the purpose of investigation. Hence, the present petitions in C.M.P.Nos.22264 & 22267 of 2024 have been filed seeking cancellation of anticipatory bail granted to them in Crl.O.P.Nos.13115 & 13116 of 2024.
3. The learned counsel for the private respondents/bail petitioners/A2 to 5/12
A5 submitted that the petitioners/A2 & A3 in Crl.OP.No.13115 of 2024 have deposited the money as ordered by this Court vide order dated 12.09.2024. He further submitted that the petitioners/A2 to A5 have not appeared before the respondent police due to their ill health and that they are ready and willing to comply the condition at present. He further submitted that the final order itself was passed in the year 2024 now the present petitions have been filed seeking cancellation of the bail granted to them is not necessary. He further submitted that the bail petitioners/A2 to A5 have also filed separate petitions in Crl.M.P.No.24212 of 2025 (for A2 & A3) and Crl.M.P.No.302 of 2026 (For A4 & A5) seeking modification of the condition imposed by this Court in Crl.OP.Nos.13115 of 2024 and 13116 of 2024 vide separate order dated 12.09.2024 that their appearance before the respondent police on every Saturday at 10.00 a.m., for the period of four weeks to be relaxed.

The learned Government Advocate (Crl.Side) appearing for the respondent State in all the petitions submitted that in this case investigation is not concluded and that the bail petitioners/A2 to A5 are not complied the condition as ordered by this Court in Crl.OP.Nos.13115 of 2024 and 13116 of 2024 dated 12.09.2024 that they have not appeared before the respondent police on every Saturday at 10.00 a.m., for the period of four weeks. Hence, 6/12
she prays to cancel the anticipatory bail granted to the bail petitioners/A2 to A5 and consequently, dismiss the modification petitions filed by them.
5. I have heard the submissions made on both sides and also perused the materials available on record.

It is stated that the bail petitioners/A2 to A5 in Crl.OP.Nos.13115 & 13116 of 2024 have not complied the condition for appearance before the respondent for the period of four weeks as ordered by this Court and now expressed their willingness to appear before the respondent police. However, the bail petitioners/A2 & A3 in Crl.OP.No.13115 of 2024 have complied the other conditions imposed by this Court with regard to deposit of money of Rs.10 lakhs each to the credit of crime number. It is also stated that the defacto complainant has already withdrawn the said amount deposited by the bail petitioners/A2 & A3.
7. Considering the above facts and submissions, this Court is of the view that the anticipatory bail was granted in the year 2024 and after nearly two years the present petitions have been filed by the defacto complainant, 7/12
cancellation of bail to the bail petitioners/A2 & A3 in Crl.OP.No.13115 of 2024 is not necessary. Further, they have already complied the condition that they have deposited the money as ordered by this Court vide order dated 12.09.2024 in Crl.OP.No.13115 of 2024. Now, the bail petitioners/A2 & A3 expressed their willingness that they are ready to appear before the respondent and comply the condition, this Court is of the view that the bail petitioners/A2 & A3 may be given an opportunity to comply with the condition imposed by this Court vide order dated 12.09.2024. Hence, this Court is inclined to extend the time to the bail petitioners/A2 & A3 in Crl.OP.No.13115 of 2024, consequently, the cancellation of anticipatory bail petitions filed against them is liable to be dismissed.

As far as the bail petitioners/A4 & A5 in Crl.OP.No.13116 of 2024 is concerned, they have not complied the condition even a single day for appearance before the respondent police as ordered by this Court vide separate order dated 12.09.2024 and now they filed a petition seeking modification of the very same condition, this Court is of the view the same is not entertainable. Since the bail petitioners/A4 & A5 in Crl.OP.No.13116 of 2024 were not complied any of the conditions imposed by this Court including surrendering before the learned Judicial Magistrate now, in the year 2026, they have come 8/12
forward with a petition seeking modification of the very same condition, this Court is not inclined to modify the same, and consequently, the cancellation of the anticipatory bail petition filed by the defacto complainant against the bail petitioners (A4 & A5) is liable to be allowed.

Accordingly, (i) Crl.M.P.No.24212 of 2025 in Crl.OP.No.13115 of 2024 seeking modification of the condition is modified that the bail petitioners/A2 & A3 shall appear before the respondent police daily at 10.30 a.m., for a period of four weeks starting from 09.03.2026 onwards and thereafter as and when required for interrogation. It is made clear that, no further extension of time will be entertained.
(ii) Crl.M.P.No.22267 of 2025 in Crl.OP.No.13115 of 2024 seeking cancellation of anticipatory bail against the bail petitioners/A2 & A3 shall stand dismissed.
(iii) Crl.M.P.No.302 of 2026 in Crl.OP.No.13116 of 2024 seeking modification of the anticipatory bail condition imposed on the bail petitioners/A4 & A5 shall stand dismissed.
(iv) Crl.M.P.No.22264 of 2025 in Crl.OP.No.13116 of 2024 9/12
seeking cancellation of anticipatory bail filed by the defacto complainant against the bail petitioners/A4 & A5 shall stand allowed. The anticipatory bail granted to the bail petitioners/A4 & A5 vide order dated 12.09.2024 in Crl.O.P.No.13116 of 2024, shall stand cancelled, consequently, the respondent Police is directed to take appropriate steps in this regard. 17.02.2026 ssi To 1.The Inspector of Police, Central Crime Branch-I (C.C.B-1), Vepery, Chennai-600 007.
